With the abolition of this provision, India has also lost its legal justification on the basis of which it used to justify its occupation of Jammu and Kashmir. Now according to India’s own legal standards, the occupation of Kashmir is usurping and unjustified. Secondly, the Modi government has closed all doors for a peaceful and negotiated solution to the conflict. The Modi government has not only refused to hold bilateral talks with Pakistan, but has also refused to accept third-party mediation. The recent invasion of India and the possible crackdown on the Kashmiri movement will increase the local pressure on the Pakistani government to support the Kashmiri freedom struggle and such support will be justified in every way.
The principle of impartial referendum proposed in Security Council Resolution 47 (1948) and other subsequent resolutions legitimizes the right of the people of Jammu and Kashmir to self-determination. The United Nations General Assembly, through its resolution 2649 (1970) and several other resolutions, has repeatedly affirmed the legitimacy of the struggle of people living under colonial and external domination. According to the resolutions, “They have the right to self-determination.” is recognized” and that “every available means, including armed struggle, may be used to protect this right”. It also recognizes the right to demand and receive it. Whether Pakistan helps Kashmir’s freedom struggle or not, India will in any case accuse Pakistan of “cross-border terrorism” and threaten to use force or attempt airstrikes or military incursions. The world is aware that the India-Pakistan conflict can turn into a devastating war and the situation can reach the level of nuclear weapons. To avert this threat, the members of the Security Council, other states and international organizations will make every effort to take all measures to prevent the situation from worsening.
The United Nations and the main powers of the world will try their best to persuade India to withdraw its decision and for a successful peace process with Pakistan and the Kashmiri people, but Modi is a thief drunk on power. India’s long-standing occupation of Kashmir may soon turn into an Afghan war-like quagmire that will erode the confidence of the Indian armed forces, create political divisions, and sink the economy. Where India and Israel have been playing fire and blood for more than half a century, and the whole of Europe, including America, has been watching this game for a long time. A pacifist painfully intelligent person is wondering how long these brutal games will continue. The easy solution to the conflict of Kashmir and Palestine is that it is the international and moral responsibility of the major powers of the world to solve these two problems according to the resolutions of the United Nations. The United Nations has promised to give the right of referendum to more than fifteen million people of the state of Jammu and Kashmir and the two-state solution of Palestine and Israel, but until today, the United Nations is playing the role of the handmaiden of the United States and the West and is only limited to statements. has been playing its role till now, after which it has become necessary that the United Nations should not lose its footing in giving this right, otherwise, with the speed with which the world is running towards complete darkness, I am afraid from that day that A small spark of the fire of intolerable cruelty will change the map of the whole world and it will be a great injustice to all those who want to see this world as a cradle of peace.
